That is pretty much what I have been advocating for while and it is a fact hard to deny that FPS is based on FGFS.

The statement FPS is the same as FlightGear in turn is wrong as it is not true. Not from a legal standpoint and not from a factual one. FPS themselves have refrained for a while from claiming this. The largest part of FPS is FlightGear, of course but they added more to it and legally rebranded it into a new product.
Therefore stating to offer downloads for a commercial program for free is a troublesome statement. It either implies that you distribute the pirated copy or make a false advertising by claiming both products are equal.

Gooney´s proposal is imho the best variant we can provide (besides starting legal actions if possible).

Hello! I think one of the most fatal things Mr. "Dan Freeman" does is that he/she/it uses a well-conceived affiliate-system, so the John Doe get linked by many websites (e.g. Facebook) to it and it becomes very fast relatively popular :evil:
But the biggest joke are the information-pages and (so called) "reviews" of Proflightsimulator in some reference to Flightgear, one example is

These fake post will say things like "I just bought Pro flight simulator and it doesn't work at all, did I get scammed" Then that poster makes another 5 accounts at that forum and post fake replies like "man, you can get that game for free" or "get flight gear it's free". Notice the sign up dates are the same date lol.
stupefying, isn´t it? They accuse us practicing their dirty methods...





Next, i did some research about the guys selling PFS. Their "physical address" is supposedly located in Sydney, Australia, Hickson Road No. 13, Walsh Bay. You can visit exactly this location in Google Maps, and, even in 3d with Google Street View! So, at this address, i just found an establishment called "Shore Studios 2/3", and no further information, so i suppose it´s a "brass plate company", anyway, extremely dubious... So much to "Dan Freeman" :roll: In addition to that, their website says that they´re a member of the "IDB Pacific Group". This seems to be a "club" for GPL-Rebranders (well, ok, not a club; propably just one person who wants to make fast cash :idea: ) :
When grabbing deeper, you can find another "extremely cool and realistic and something everyone has been waiting for and (of course) new product" provided by our endearing "IDB Pacific Group": FREE!Ship; its a software to design and test your self-made boat-design, and it is released under the GPL. Now, our guy from the "IDB pacific group" put his logo on that, called it

and sells it for only 49,95 USD on his (surprisingly, it looks from the layout almost like the PFS-Page...) Website named

And the best: the same methods written above (the faked "reviews" neglecting the scam) are used here as well! And the, buhahahaha, developer, of this software, is known under the sexy name "Andrew Casey" :D


Well, at the end of my "investigation" i made some whois-requests and found out the location of some servers from their static IP addresses: All sites (The Boat-Software, PFS and the "Scam-Review"-Pages) are located in the USA, and pretty much were registered by the internet registrar "GoDaddy". GoDaddy ownes the company "Domains by Proxy" (see http://en.wikipedia.org/wiki/Domains_by_Proxy) which hides the identity of Domain-Owners at WHOIS-requests. At two sites, i found exactly this company-name at the WHOIS-Results...

I'm sure there's a snag. It is not the Copyright issues- it is the whole financial system which smell fishy. 75% commission ??

I was reviewing a third-party analysis of my blog traffic today, and I ran across an interesting data point. According to the the report, someone had found my article about PFS by using the keywords "cody moya scams." That name sounded familiar.

Let me quote from my own blog entry, http://zyzmog.blogspot.com/2011/06/proflightsimulator-is-now-earth-flight.html:
Earth Flight Sim's "Contact Us" page is empty right now, except for the notation "Coming Soon". ... "Whois" reports that the domain name is registered to Cody Moya, of Short Hills NJ, but most domain names nowadays are registered to a third party, not the entity that actually uses the domain name.


I guess I should have been more credulous about that domain registration.

Intrigued, I decided to search for "cody moya scams" myself. Wow. The results of that search prompted a new blog entry: http://zyzmog.blogspot.com/2012/03/proflightsimulator-getting-to-bottom-of.html

As a previous poster noted, "Dan Freeman" is probably a bogus persona - a sock puppet. So far, the evidence is circumstantial, but the evidence suggests that this very successful scammer/spammer, "Cody Moya," is behind PFS and it's just another one of his scams.

They take a software which is available under GPL, rebrand it and sell it. This is legal as it is not forbidden by the license.
As long as they stick to the GPL. The overall impression here is that they don´t but this has yet to be put on solid ground.

What we know they do is aggressively marketing FPS with false advertising - reportedly using fake reviewers and web sites, pictures and videos from FGSF, wrong facts and more. Which is something hardly to come by on a legal basis. Though it violates a few regulations (which are interpreted differently in several countries - not to speak from the moral aspect) it is extremely difficult to enforce it.

I saw somewhere in this thread about Blender being packaged as 'Illusionware'. Would you think this has any affiliation to our problem (in the sense that this guy also did that as well)? I did notice on the ProFlightSim page that they were in fact packaging Blender 2.5/6 with it.

This guy is targeting everyone, especially the best open-source software out there (I wouldn't expect to see a repackaged GIMP or Inkscape coming soon from him).
